A Story from My Own Journey
Before we look at the documents, I want to share something personal. Back in 2019, I was working long shifts at a factory, just like many of you are doing now. I remember the feeling of walking into work and hearing a rumor that "the rules were changing." No one explained how they were changing, only that we should be afraid.
I spent that whole week looking over my shoulder, wondering if I had signed the right papers or if my family was safe. It was exhausting. Eventually, I realized that the fear came from not having the facts. Once I sat down with someone who could explain the system in plain language, that heavy weight lifted off my shoulders.

What is the Indiana FAIRNESS Act (SEA 76)?
The Indiana FAIRNESS Act is a new state law that changes how businesses in Indiana check if their workers are allowed to work in the United States.
In the past, the rules mainly came from the federal government in Washington, D.C. Now, the state of Indiana has made its own strict rules. The most important thing to know is that this law officially starts on July 1st, 2026.
What does it do?
It makes it illegal for any employer in Indiana: no matter how small the company is: to hire or keep someone on staff if they do not have the proper work authorization. If a company breaks this rule, the state can fine them up to $10,000 per violation. That is a lot of money, and it is why many employers are feeling nervous and asking their workers for more documents lately.
The July 1st Deadline: Why Now?
We are currently in mid-June. That means the July 1st deadline is less than three weeks away.
You might notice your boss or the human resources (HR) office at your job asking you to update your paperwork or sign new forms. Do not rush and sign something you don't understand. It is natural for companies to want to be ready before the law starts so they don't get fined.
At Astek, we encourage you to stay steady. This law applies to new hires (people starting a job after July 1st) and current employees (people who are already working). This means your employer might be double-checking their files for everyone on the team.
Understanding E-Verify
The biggest change with the FAIRNESS Act is a system called E-Verify.
Think of E-Verify like a digital "background check" for your right to work. It is an internet-based system that compares information from your Form I-9 (the form you fill out when you start a job) against records from the U.S. Department of Homeland Security and the Social Security Administration.
Under this new Indiana law, if an employer uses E-Verify, the state assumes they are following the law. If they don't use it and there is a problem, they face those big $10,000 fines. Because of this, almost every business in Indiana will likely start using E-Verify for every single worker.
